These Terms & Conditions govern the use of the SmōkHaus website and the purchase of products from SmōkHaus. By accessing this website, enrolling in messaging programs, or placing an order, you agree to be bound by these Terms & Conditions.

1. Eligibility and Legal Compliance
SmōkHaus sells tobacco products intended for adults only. By using this website, enrolling in communications programs, or placing an order, you confirm that you are at least 21 years of age.
SmōkHaus actively verifies age at checkout and requires an adult signature upon delivery. Orders that fail age verification will be canceled without fulfillment.

2. Products and Authenticity
All cigars sold by SmōkHaus are authentic, premium tobacco products sourced from authorized distributors and trusted partners. Tobacco products are natural and may vary in appearance, aroma, and flavor.
3. Orders and Payments
All prices are listed in U.S. dollars. SmōkHaus accepts major credit and debit cards and may offer PayPal as a payment option.
By completing a purchase, you authorize SmōkHaus to charge the selected payment method for the full order amount, including applicable taxes and shipping fees.
All orders are final once submitted. Orders begin processing immediately and cannot be modified or canceled.
Order Review & Verification
To protect our customers and reduce the risk of unauthorized transactions, SmōkHaus reserves the right to manually review certain orders before fulfillment.
Orders may be subject to additional review under the following circumstances, including but not limited to:
First-time customer orders
Orders where the billing and shipping addresses do not match
Orders flagged by our payment processor or fraud prevention systems
High-value or bulk purchases
During a manual review, we may temporarily place the order on hold and request additional verification. This may include confirmation of billing information, identity verification, or order confirmation via email or phone.
If requested verification is not completed within a reasonable timeframe, SmōkHaus reserves the right to cancel the order and issue a refund to the original form of payment.
Manual review may result in a short delay in order processing. This process is part of our commitment to secure transactions and responsible retail practices.
4. Shipping and Delivery
SmōkHaus ships within the United States only. International shipping is not available.
We will NOT ship outside the U.S. under any circumstances.
Orders typically ship within 1 to 2 business days. Delivery times vary based on carrier and destination.
All shipments require an adult signature upon delivery. This requirement cannot be waived. SmōkHaus does not ship to P.O. boxes.
If a delivery attempt is missed, the carrier may attempt redelivery or hold the package at a local facility. The customer is responsible for retrieving the package. SmōkHaus is not responsible for delays, returned shipments, or additional fees resulting from missed delivery attempts.
5. Risk of Loss and Responsibility
Responsibility for an order transfers to the customer upon confirmed delivery by the carrier. Adult signature confirmation serves as proof of delivery.
SmōkHaus is not responsible for loss, theft, or damage after confirmed delivery.
6. Storage and Product Care
SmōkHaus stores all cigars in climate controlled environments with strict temperature and humidity standards prior to shipment. Orders are shipped with humidity protection.
Proper storage after delivery is the responsibility of the customer.
7. Returns, Refunds, and Exchanges
Due to the nature of tobacco products, all cigar sales are final once delivered.
Exceptions may be made only for incorrect or damaged items reported within 48 hours of delivery. Approved cases may result in a replacement or refund at SmōkHaus discretion.
Returns are accepted only on a limited, case by case basis. Approved returns must be unused, unopened, and in original condition. Items returned in unacceptable condition will not be refunded.
In approved cases, SmōkHaus covers return shipping. Unauthorized returns will not be accepted.
Refunds are issued to the original form of payment after returned items are received and inspected.
8. SMS Messaging Terms
If you choose to opt in to receive SMS messages from SmōkHaus, you consent to receive text messages related to orders, account activity, promotions, new product releases, and other marketing communications.
Message frequency may vary.
Standard message and data rates may apply depending on your mobile carrier and service plan.
You may opt out of SMS communications at any time by replying STOP to any message you receive from SmōkHaus. After opting out, you will no longer receive SMS messages unless you choose to re enroll.

Your consent to receive SMS messages is not a condition of purchasing any goods or services.
Mobile carriers are not responsible for delayed or undelivered messages.

9. Disputes and Chargebacks
If you experience an issue with an order, you agree to contact SmōkHaus directly before initiating a payment dispute or chargeback. Most issues can be resolved quickly through our support team.
Failure to contact SmōkHaus prior to initiating a dispute may result in delayed resolution.
10. Manufacturer Warranties
Cigars are natural products and are not covered by manufacturer warranties. Variations in construction, burn, or appearance are inherent to handmade tobacco products.
11. Limitation of Liability
To the fullest extent permitted by law, SmōkHaus shall not be liable for indirect, incidental, or consequential damages arising from the use of this website or the purchase of products.
Total liability shall not exceed the amount paid for the affected order.
